ASA cracks down on 'misleading' sponsored web links on Freeserve
In a busy week for the Advertising Standards Authority, the regulatory body has upheld a complaint that search listings provided by the ISP (generated by Overture) were misleading - it was not clear that the results were sponsored links and they were ranked according to the amount of money sponsors had paid. Freeserve argued that each sponsored link had an associated hyperlink that explained the ranking system being used.
However, the ASA ruled that 'Because sponsored links were not clearly identified by a headline or title, and the search page did not contain an explanation of the purpose of the hyperlink, the Authority considered that consumers were unlikely to realise that the Overture hyperlink indicated that results were sponsored and concluded that consumers could be misled. ...more
